When specifications or requirements (including materials and methods) are provided by client, we at Oxgate Surfacing do not guarantee durability or suitability of such specification
When subbase, foundation or ‘prep’ is carried out by the client, or re-surfacing / overlay of existing surface it is assumed that the foundations and any prep work including edgings or kerbings are sufficient and adequate in every way. Any damage or faults to the finished surface due to the foundations or ‘prep’ work will be the client’s responsibility.
Quotations are submitted on the condition that if accepted, all necessary permission for the execution of the work has been or will be obtained by client.
It is the client’s responsibility not only to provide adequate clear area for work to be laid, but also sufficient clear space for all plant, vehicles and machinery ancillary to that work. And for work areas to be ready for us on arrival to site.
Drainage unless otherwise detailed our proposal as part of our specification is the responsibility of the client. When planning, overlaying, following kerb-lines, or laying on client-prepped subbase or foundations, client is responsible for levels and cambers that might affect water and drainage.
Newly laid macadam is a flexible material which hardens as the oils evaporate. The company accepts no responsibility for damage caused by the client or any third party to the surface before evaporation has taken place, or by spillage of any hydrocarbon base materials. (petrol, oil etc). New surfaces must be kept clear and adequate aftercare.
An instruction or order to commence work, implies that the areas concerned are ready to receive surfacing materials on the scheduled date of commencement of works. Should labour, materials or plant arrive on site, and the areas are not ready, any expenses incurred will be charged to the client.
When laying tarmacadam/resin on a concrete base, there is no guarantee against fracturing or cracking due to movement of the concrete. Client understands that tarmac is only as good as the foundations laid upon, existing surfaces that are prone to movement will affect the tarmac.
Variations in quantities of specification must be notified by client and agreed upon prior arrival on site.
Any variation in quantity of work completed from that stated in our quotation or from the enquiry will be charged pro-rata and any additional material used for groundwork which is not properly made up will be charged pro-rata.
When planning works are required, we cannot be responsible for the quality of the sub-base underneath, and therefore cannot rule out a change in specification, which would be discussed on site.
When excavating or building up foundations in preparation of laying, unforeseen findings in the subbase or underground might require a change or specification.
When client has requested works commence on specific date, we do not take responsibility for any defects arising due to the weather.
Unless otherwise agreed, payment is strictly on receipt of invoice. Retention will not be allowed unless the rate and duration are agreed at the time of ordering or outlined on PO.
All materials remain the property of the company until payment is made in full and in the case of default will be removed as deemed necessary.
All workmanship fully guaranteed for 12 months
Any default in the payment terms and conditions could result in a weekly 5% of the invoice amount being charged to the client.
When overlaying, it is assumed the client is aware of depths and agrees to the levels, contours, inclines being laid at.
When client has prepared or installed drainage, gullies, ACO, inspection covers, manholes covers, utility boxes or any other such fixtures, if faults occur to the tarmac or other aspects of our work due failure of these items or inadequate preparation such as sinking or shifting of tarmac, client is responsible / liable for this.
